PRIVACY POLICY

We (Ziyou Technologies Pvt. Ltd. or "Float") recognise that your privacy is very important and take it seriously. This Privacy Policy ("Privacy Policy") sets out how we collect, use and disclose your data when you use our website https://floatvoicechat.com ("Website") and/or mobile application called Float ("App"). The Website and App are collectively referred to as the "Platform". References to "we", "our" or "us" or the "Company" shall mean the Platform and/or Ziyou Technologies Pvt Ltd. Any references to "you", "your" or "user" shall mean any person or entity using our Platform. We will not use or share your information with anyone except as described in this Privacy Policy. This Privacy Policy is a part of and is to be read with the Float Terms of use ("Terms") and our Float Cookie Policy. By using this Platform, you agree to the terms and conditions of this Privacy Policy. You also consent to our use and disclosure of your Personal Information (as defined below) in the manner described in this Privacy Policy. The capitalized words used in this Privacy Policy but not defined herein, shall have the meaning given to such words in the Terms. If you do not agree with the terms and conditions of this privacy policy, please do not use this platform.

The information we collect

Log-in Data

User ID, mobile phone number, password, gender, and IP address. We may collect an indicative age range which tells us that you are of the appropriate age to access our Platform and certain features of our Platform (collectively, "Log-in Data").

Additional Profile Information

Alongside the Log-in Data, we also collect your photo and the biography provided by you on your user profile.

Content You Share

This comprises all of the information you make available to other users via Platform, comprising such as:

Information about you or relating to you that is voluntarily shared by you on the Platform, including without limitation, any quotes, images, political opinions, religious views, etc.
Any posts that you make on the Platform (including your public profile, the lists you create on the Platform, and photos, videos and voice recordings and photos through your device’s camera and/or microphone sensor), any postings from others that you re-post and Location Data and Log Data associated with such postings.
This also includes information about you (including Location Data and Log Data) that other users of the Platform share about you or any communications they make to you.

Information we receive from other sources

We may also be working closely with third parties (including, for example, business partners, sub-contractors in technical, analytics providers, search information providers) and may receive information about you from such sources. Such data may be shared internally and combined with data collected on this Platform.

Log Data

"Log Data" is information that we automatically collect when you use the Platform, whether through the use of cookies, web beacons, log files, scripts, including, but not limitedto:

technical information, such as your mobile carrier-related information, configuration information made available by your web browser or other programs you use to access the Platform, your IP address and your device’s version and identification number;
information about what you have searched for and looked at while using the Platform, such as web search terms used, social media profiles visited, mini applications used, and details of other information and content accessed or requested by you while using Platform;
general information about communications on the platform, such as the identity of a user that you have communicated with and the time, data and duration of your communications; and metadata, which means information related to items you have made available through the Platform, such as the date, time or location that a shared photograph or video was taken or posted.

Cookies

Our Platform uses cookies to distinguish you from other users of our Platform. This helps us to provide you with a good user experience when you browse our Platform and also allows us to improve the Platform. We collect the cookie data from the cookies on your device.

Surveys

If you choose to participate in a survey, we may request you to provide certain Personal Information i.e. any information that could be used to identify you ("Personal Information"). We may use a third-party service provider to conduct these surveys and this will be notified to you prior to you completing the survey.

User Search Data

Any searches you make on the Platform.

Additional Account Security

We collect your phone number and request access to the SMSs on your phone by sending you a One-Time-Password ("OTP"), which you confirm by entering the OTP to confirm your identity, while registering with our Platform.

Chat Data

We collect the content of any communications between you and another user, when you use any chat feature on the Platform. This is stored on your device and the devices of the users that you have sent communications to. However, we do not monitor your chat data, take any action based on your chat data or disclose it to any third party.

Location Information

"Location Data" is information that is derived from your GPS, IP address, and/or public posts that contain location information. You will disclose certain location information to us and to other Platform users:

when you use certain location-based features on the Platformand/or any other feature or mini applications that we may introduce on our Platform from time to time, and when you share your location with other Platform users; and
when you access the Platform, as we derive location information from your IP address, device, or internet service to prevent multiple or fraudulent log-ins to your account.

Customer Support Information

Any information that you provide to our customer support team regarding any assistance or support that you may require for using our Platform from time to time.

Device Data

"Device Data" includes without limitation, the following:

Device attributes: information such as the operating system, hardware and software versions, battery level, signal strength, available storage space, browser type, app and file names and types, and plugins.
Device operations: information about operations and behaviours performed on the device, such as whether a window is foregrounded or backgrounded.
Identifiers: unique identifiers, device IDs, and other identifiers, such as from games, apps or accounts you use.
Device signals: We may collect your Bluetooth signals, and information about nearby Wi-Fi access points, beacons, and cell towers.
Data from device settings: information you allow us to receive through device settings you turn on, such as access to your GPS location, camera or photos.
Network and connections: information such as the name of your mobile operator or ISP, language, time zone, mobile phone number, IP address and connection speed.
Application: Any mobile applications that are stored on your mobile device.
Media: We access the media gallery on your mobile device, including without limitation, images, videos and audio files and the storage space on your phone. However, we shall always obtain your consent before accessing your images and you shall have the option to deny us such access.

Contest Information

Any information that you provide to us in submitting an entry to any contest which may be offered on the Platform from time to time.

Disclosure of your information

Public content i.e. any content you post on your user profile or on another user’s profile, such as a post comment, is accessible to everyone, including search engines. Any information you voluntarily disclose for posting to the Platform, including your profile page information, is accessible to anyone. When you submit, post or share the content that you choose to make public, on the Platform, it may be re-shared by others. You should consider who you choose to share it with, because people who can see your activity on our Platform can choose to share it with others on and off our Platform, including people outside the audience you shared it with. For example, when you share a post or send a message to specific users of our Platform or accounts, they can download or re-share that content with other users across or off our Platform. Also, when you comment on someone else's post or like their content, your comment or like is visible to anyone who can see the other person's content. Please note that you also have the option to make your profile private in order to ensure that only followers approved by you can see your posts.

Users can also use our Platform to create and share content about you with the audience that they choose, such as posting a photo of you, or tagging you in any of their posts. We reserve the right to share all public content on any social media site or any other online or offline platform. We will never rent or sell your Personal Information to third parties, except on an anonymized basis, unless expressly provided in these Terms.

Sharing with our group of companies

We may share your Personal Information with any member of our Group. The term "Group" shall mean any entity that is controlled by us, or any entity that is in control of us, or any entity that is under common control with us, whether directly or indirectly.

What you share with Others

When you share content and communicate using our Platform, you choose the audience for what you share. For example, when you post any content from our Platform on Facebook, you select the audience for the post, such as a friend, a group of friends or all of your friends. Similarly, when you use WhatsApp or any other application on your mobile device to share the content on our Platform, you choose who you share the content with. We do not control and shall not be liable for the manner, in which such persons (with whom you choose to share content via any sharing options, such as WhatsApp or Facebook, available on the Platform) use the information that you share with them.

Sharing with Third Parties

We may share your information (including Personal Information) with select third parties including:

Business partners, suppliers and sub-contractors ("Affiliates"). Affiliates may use this information to help provide, understand, and improve the Service and Affiliates’ own services for the performance of any contract we enter into with you.
Advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we may provide them with aggregate information about our users (for example, we may inform them that any given number of women in a specified age group clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target.
Government bodies or law enforcement agencies, if we have good-faith belief that it is reasonably necessary to share your personal data or information in order to comply with any legal obligation or any government request; or to protect the rights or prevent any harm to the property, or safety of the Company, our customers, or public; or to detect, prevent or otherwise address public safety, fraud, security or technical issues.

We may also disclose your information (including Personal Information) to select third parties in the following circumstances:

If the Company or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets. If we are involved in a merger, acquisition, bankruptcy, reorganization or sale of assets such that your information would be transferred or become subject to a different Privacy Policy, we will notify you in advance so you can opt out of any such new policy by deleting your account before transfer.

Disclaimer

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your Personal Information, we cannot guarantee the security of your data transmitted to the Platform; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Your Rights

You are free to remove or delete content from your user account/profile and your account/ profile at any point in time. However, the history of your activities and account on our Platform remains available to us. You may correct, amend, add or delete Personal Information from your account at any time by logging in and visiting your profile page. As noted above, you may opt out from unwanted e-mail communications from us by following the instructions in the message. However, until your account is deleted you will continue to receive all system e-mails. However, please note that revoking your consent may negatively affect your use of the Platform. For instance, we need access to your mobile device’s media folder and camera so that you can click pictures from your mobile device and post them on the Platform, which functionality will not be available to you if you do not provide us such access. You may also ask us not to process your personal data for marketing purposes. You can exercise any of these rights at any time by contacting us at support@floatvoicechat.com However, we require a reasonable period of 30 (thirty) days to comply with any of your requests.

Data Retention

We do not retain your Sensitive Personal Information (defined below in this paragraph) for longer than is required for the purposes for which the information may be lawfully used. For any other content, we will entertain your request for deletion, however, there is a strong possibility that copies of any public content will be retained indefinitely in our systems, including in cached and archived pages of the Platform, or if other users have copied or saved that information. In addition, due to the nature of the internet, copies of your content, including content that you have removed or deleted from your account, may also exist elsewhere on the Internet and be retained indefinitely.

Third Party Links

The Platform may, from time to time, contain links to and from the websites of our partner networks, advertisers, Affiliates and/or any other websites or mobile applications. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites or mobile applications.

Third-Party Embeds

Some of the content that you see displayed on the Platform is not hosted by the Platform. These "embeds" are hosted by a third-party and embedded in the Platform. For example: YouTube or Vimeo videos, Imgur or Giphy gifs, SoundCloud audio files, Twitter tweets, or Scribd documents that appear within a post on the Platform. These files send data to the hosted site just as if you were visiting that site directly (for example, when you load a Platform post page with a YouTube video embedded in it, YouTube receives data about your activity).

Privacy concerns with third party embeds

The Platform does not control what data third parties collect or what they will do with it. So, third-party embeds on the Platform are not covered by this Privacy Policy. They are covered by the privacy policy of the third-party service.

Sharing personal information with third party embeds

Some embeds may ask you for Personal Information, such as your email address, through a form. We do our best to keep bad actors off of the Platform. However, if you choose to submit your information to a third party this way, we don’t know what they may do with it. As explained above, their actions are not covered by this Privacy Policy. So, please be careful when you see embedded forms on the Platform asking for your email address or any other Personal Information. Make sure you understand who you are submitting your information to and what they say they plan to do with it. We suggest that you do not submit Personal Information to any third-party through an embedded form.

Creating your own third party embed

If you embed a form that allows submission of Personal Information by users, you must provide near the embedded form a prominent link to an applicable Privacy Policy that clearly states how you intend to use any information collected. Failure to do so may lead the Company to disable the post or take other action to limit or disable your account.

Communications from us

We may from time to time send you service-related announcements when we consider it necessary to do so (such as when we temporarily suspend the Platform for maintenance, or security, privacy, or administrative-related communications). We send these to you via SMS. You may not opt-out of these service-related announcements, which are not promotional in nature and used solely to protect your account and keep you informed of important changes to the Platform.

These Content and Community Guidelines ("Guidelines") govern your use of our website located at https://floatvoicechat.com and/or the Float mobile application (collectively, the "Platform") and is made available by Ziyou TechnologiesPvt. Ltd. ("Float", "Company", "we", "us" and "our"), a private company established under the laws of India having its registered office at Sarjapura Road, Attibele, Bengaluru, Karnataka 562107. The terms "you" and "your" refer to the user of the Platform.

These Guidelines are to be read with the Float Terms of Use, the Float Privacy Policy, and the Float Cookie Policy (collectively, "Terms"). The capitalized words used in these guidelines shall have the meaning given to such words in the Terms.

Please note that we may change these Guidelines from time to time and we reserve the right to do so.

Our Platform connects you with people from across India and other parts of the world. The community that we have created is diverse and receptive to a variety of content, but the Platform is accessed by a variety of audience, which may include minors and young adults. Hence, in order to ensure that all our users follow a standard practice and to foster a safe environment for you to creatively express yourselves, we have put in place strict guidelines and restrictions which govern the usage of the Platform .

Content Guidelines

We actively remove content which is not allowed on our Platform and violates both our Guidelines as well as applicable Indian laws. If such content comes to our attention, we may take it down or ban user accounts. If you come across any content that violates these Guidelines, we encourage you to report it. The intent of the creator is important. We understand the importance of creative freedom, however we do not welcome content that intends to bring discomfort, spread what may be considered hate speech and abuse or promote violence and illegal activities.

Nudity and Pornography

We allow content that may have limited sexual imagery, provided it is posted for artistic and educational purposes, public awareness, humour or satirical purposes. Content which contains the following is prohibited on the Platform and will be considered as a strict violation of these Guidelines:

obscene,sexually explicit, pornographic or nude material or images/videos that expose private parts (sexual organs, female breasts and nipples, buttocks) and/or portray sexual activities;
videos or images of people in compromising positions or content which portrays sexual actions or fetish or erotic intent or sexual arousal;
sextortion or revenge pornography;
Bestiality or zoophilia;
sextortion or revenge pornography;
content that exploits or endangers any person (for example, listing of phone numbers, or other personal information aimed at any exploitation or endangerment of a person including for the purposes of encouraging or soliciting prostitution or escort services);
content that is paedophilic or related to child pornography (including without limitation, creation, promotion, glorification, transmission or browsing of child pornography); or
content that is indecent, immoral or related to rape, sexual objectification, non-consensual activities and molestation.

Harassment or Bullying

We strongly condemn any kind of harassment or bullying on our Platform. We intend to give our users the freedom to express themselves without the fear of emotional or psychological distress. We urge you to ignore any content that you may find petty and annoying. In addition to this, we also encourage you to report any such content that harasses another person or intends to degrade or shame any individual.

Content which qualifies as a violation of these Guidelines includes, but is not limited to:

Posting abusive language or curse words, morphed images, and/or malicious recordings.
Objectifying, insulting or harassing someone based on their race, caste, colour, disabilities, religion, sexual preferences and /or making sexual advances or otherwise engaging in sexual misconduct will not be tolerated on this Platform. Similarly, extorting or blackmailing any individual otherwise or on the basis of the abovementioned content is strictly prohibited.

However, if a matter involves critical discussion and deliberation of such individuals who are featured in the news or tend to have a large public audience, we may allow it subject to the Terms and these Guidelines.

Intellectual Property

We aim to safeguard intellectual property rights and consider violations of such rights as serious misconduct. All content such as literary, musical, dramatic, artistic, sound recordings, cinematographic works is subject to intellectual property protection.

Posting content on the Platform which is not original and is copied from an individual/organisation who owns the intellectual property rights in such content/ works is not allowed. Any content which violates the intellectual property rights of third parties will be taken down and strict action will be taken against users who are repeat defaulters. If you wish to reshare such content from within the Platform, kindly do not remove any attributions, watermarks and original captions which state the authentic source of the content. In addition to this, please take the required permissions and give due credits to fellow users or any other organisation/individual who own the intellectual property rights in such content by mentioning their name and /or the original source.

Violence

Violence includes all content that causes discomfort to our users due to the goriness in the content, such as but not limited to graphical images or videos that glorify violence and suffering, or intends to incite violence, depiction of physical violence or animal cruelty. Content which promotes dangerous and illegal activities, or praises individuals, groups or leaders involved in terrorism, organized violence or criminal activities is strictly prohibited.

Educative or informative content pertaining to violence may be allowed on the Platform. Violent content on the Platform in the form of fictional set-up, martial arts may be permitted subject to these Guidelines.

Hate Speech and Propaganda

Content that promotes violent behaviour against an individual or a group of individuals, intends to intimidate, target or demean any particular religion, race, caste, ethnicity, community, nationality, disability (physical or mental), diseases or gender, is prohibited. Any kind of content which produces hatred or has the intention of creating or spreading hatred or hate propaganda along the lines of including, but not limited to religion, caste, ethnicity, community, sexual orientation, or gender identity is also not allowed. We do not entertain content that spreads discrimination, intends to justify violence based on the above-mentioned attributes and refers to an individual or a group of individuals as inferior in any sense or with negative connotations.

We urge you to refrain from incendiary commentary and publishing theories or hateful ideologies that may cause outrage to our users and influence them negatively. We may permit such content which intends to raise awareness about these issues or challenge it, subject to clear intention of posting such content on the Platform.

Abuse, Self-Injury or Suicide

We do not permit content that exhibits suicide or such tendencies, triggers self-injury and harm or encourages participation in dangerous activities. Posting any content that relates to physical, mental, sexual, or psychological maltreatment, neglect or abuse of any person, be it that of a child or an adult, is strictly condemned. Content showcasing self-harm, glorifying self-injury or suicide or even stating instructions on how to commit self-harm through any means is not allowed. Further, content that identifies, tags, attacks and negatively targets or makes fun of victims and survivors of psychological/physical maltreatment, abuse, self-injury or domestic abuse or any other form of violence is prohibited.

We allow content that intends to provide support, aid and relief to those undergoing such serious issues. We also allow users to share their experiences which may provide coping mechanisms for those who need help, subject to the intent of posting such content.

Illegal Activities

We have zero-tolerance for content that advocates or promotes illegal activities. We prohibit content related to organized crime, criminal activities, promotion/sale/use of weapons, firearms and explosives, violence or terrorist activities. Sale of illegal goods or services, regulated goods, drugs and controlled substances, and soliciting or selling of sexual services is strictly forbidden. We do not permit content that is harassing, harmful, or abusive to children. Users may not post content that is related to or encourages money laundering or gambling.

Users are not allowed to post content that displays tutorials or instructions or educates the users about illegal and prohibited activities including, but not limited to participating in criminal activities, making bombs or encouraging or doing or trading in drugs. Do not use our Platform to solicit or facilitate any transaction or gift involving such goods and services which are declared illegal by the Government of India

Impersonating another person (such as your family, friends, celebrities, brands or any other individuals/organisations) and distributing false or misleading information on our Platform in order to make personal or financial gain will be considered fraud. Content that contains computer viruses, malware, or any other computer code designed to restrict the functionality of any computer resource cannot be uploaded on the Platform.

Non-Consensual (Personal) Content

Posting or misusing personal content or data or information of another person, including pictures or videos of other people who have not given express consent to such material being posted, is not allowed. Do not post anyone’s personal or intimate photos or videos without their permission or consent. Do not post content that is invasive of anyone’s privacy. We will remove such content.

Revealing someone’s personal data or sensitive personal information, including without limitation: contact information, address, financial information, Aadhar Number, healthcare information, sexual or intimate images and videos, passport information, or threatening someone to reveal or use such information, will be considered as harassment, and such activities are strictly unacceptable.

Spam

Content which misleads users about its origin, displays or promotes false advertisements, fraudulent or misleading representations and security breaches, falls under the ambit of spam. Such content, when posted for commercial gain, amounts to commercial spam. Spam interferes with the smooth functioning of the Platform and deters other users from sharing and connecting. It is important that the content you share is authentic and facilitates the creation of a safe and trusted environment for people to post on the Platform. Do not post the same content multiple times if it intends to annoy viewers or sell goods/services in order to promote spam, commercial or otherwise. Do not use artificial and manipulative means to generate traffic or increase followers, likes, views, comments and shares.

If you want to promote your goods or services, we urge you to do so in an authentic manner.

Misinformation

We aim to combat the spread of misinformation on our Platform. Any kind of content which spreads deliberate misinformation, disinformation, hoaxes or fake propaganda, with the intent to mislead the users or general public at large, is not permitted. We prohibit posting of content that exaggerates an existing piece of news by introducing non-factual elements into it.

We do not allow content on the Platform that misleads users or attempts to create an avenue for fabricating content, or is defamatory, libellous, or attempts to damage someone’s reputation, or hurt their financial or political standing on the basis of incorrect information. We engage third party fact checkers to combat the menace of fake news basis which we proactively warn our users that a piece of content is found to be factually incorrect. We urge you to take the same into consideration and act accordingly.

However, we do not confuse fake news with any satire or parodies. We allow for such content on the Platform provided the content does not mislead other users and the intent behind the same is not to spread false information.

COMMUNITY GUIDELINES

When you use our Platform, we expect you to follow certain norms.

Tag It Right

All posts should be tagged with the most appropriate tag. If such a tag doesn’t exist, then create one accordingly. Any content posted with an irrelevant or inapplicable tag, if reported, will be removed from the feed.

Stay on Topic

Float is a very active platform. Make sure that any content that you post, and any discussion you participate in, relates to the caption and tags of the post. Content that does not relate to the caption or tags, or is unreasonable for a particular post, will be removed. Do not go off-track.

Multiple/Fake Profiles

Creating a fake profile of an individual or organisation and impersonating someone in a misleading or deceiving manner, with or without the intention of harassing or bullying them, is not allowed. We permit exceptions for community profiles, informative profiles and fan profiles of public figures. Satire or parody accounts of public figures are also permitted as long as the intention is not to mislead other users and the same is clearly mentioned in the profile description or profile status.

Safety and Security

Harassing someone or using abusive language in the posts or comments while addressing another user is not allowed. Do not do anything which may make other users feel uncomfortable. Action will be taken against you if you try to create hostile situations for other users.

Beware of Legal Consequences

Ignorance of law is not an excuse to escape liability for your actions. In order to use our Platform, you will need to comply with laws and regulations that govern conduct in the digital environment. Kindly respect all applicable laws while using our Platform. Any content featuring, encouraging, offering, promoting, glorifying or soliciting illegal activities will not be tolerated.

Evading Suspension

Our decision to suspend any account is binding upon the user. Any attempt to circumvent the suspension by creating other accounts, identities, personalities or presence on another user's account will also result in suspension. If you try to evade suspension, we may be compelled to terminate your account with us and block you from registering with us.

PLATFORM SECURITY:

Reporting

When you see any content or activity that violates these Guidelines, please tap or click on the REPORT button. The moment you tap or click on this tab, we will get a notification and will process your request. If we find the content or activity to be unsuitable for our Platform, we will remove it. There may be such content on the Platform which you do not like but the same does not violate these Guidelines. In that case, we request you to either unfollow or block such users.

Intermediary Status and Review of Content

We are an intermediary as per the applicable laws. We do not control what our users post, comment, share or say on the Platform and are not responsible for their (or your) actions (whether online or offline). We are not responsible for services and features offered by others even if you access them through our Services. Our responsibility and liability for anything that happens on our Platform is strictly governed and limited by the laws of India.

We expect you to be responsible for what you post and what you see. If any of our users report your content to be against these Guidelines, we may take enforcement actions as necessary.

Right to Challenge

In case the content you upload or post, or your activity is reported by another user and removed from our Platform, we will notify you of such removal and our reasons for the same. If you believe that your content has been unfairly removed, you may write to us at asupport@floatvoicechat.com to challenge the removal. We may review the content again and determine if it may be reposted on the Platform.

Our Actions Against Violators

We take strict and prompt action against those who violate these Guidelines. If your profile is reported for violating these Guidelines, then your profile may be suspended temporarily. In case of repeated breach of these Guidelines, we may be compelled to terminate your account with us permanently and block you from registering with us.
